By accepting, creating an account, or using the services, you confirm you understand these terms, can legally enter the agreement, and—when acting for an organization—have authority to bind it.
Definitions
Account means the profile used to access services. Services include free virtual machines, WordPress hosting, related cloud resources, tools, and support. User Content includes data, software, text, images, video, audio, and other material uploaded, stored, processed, or transmitted through the service.
The terms also define the Acceptable Use Policy (AUP), Company IP, Data Processing Addendum (DPA), Personal Data, Privacy Policy, and the WeaveNode website and associated domains.
Eligibility and accounts
The free services are intended for registered non-profits and charities, recognized open-source projects, accredited educational institutions, and other mission-aligned organizations approved by WeaveNode. For-profit commercial use is prohibited.
- You must be at least 18 or the age of majority where you live.
- Registration information must be accurate, current, and complete.
- You are responsible for account credentials and activity under the account.
- Suspected unauthorized access or security breaches must be reported immediately.
The services
WeaveNode will use reasonable efforts to provide the services, but features and resource allocations may change. Because free services depend on funding and available resources, WeaveNode may modify, suspend, or discontinue any part of the service at any time, with or without notice and without liability.
You may not resell, sublicense, or make the service available to a third party for commercial purposes, or use it for unrelated for-profit activity.
Acceptable use
The AUP is incorporated into the agreement. Prohibited activity includes illegal, fraudulent, harmful, infringing, or deceptive conduct; child exploitation; promotion of violence or hate; phishing; intellectual-property infringement; spam; and mailing lists that are not confirmed double opt-in.
System and network abuse
- Cryptocurrency mining.
- Malware, viruses, worms, Trojan horses, or other destructive code.
- Unauthorized access, probing, scanning, or vulnerability testing.
- Launching—or, as written in the source terms, being the target of—a denial-of-service attack.
- Open relays, proxies, recursive DNS, Tor exit nodes, and similar services.
- Excessive CPU, memory, storage, or bandwidth use that degrades service for others.
WeaveNode may investigate suspected violations, suspend or terminate accounts without prior notice, remove content, and report suspected illegal activity to law enforcement.
User content and intellectual property
You keep ownership of User Content. You grant WeaveNode a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, display, and otherwise use that content only as needed to operate, maintain, secure, and improve the services. The license does not permit selling your content.
WeaveNode and its licensors retain Company IP. You are solely responsible for your own backups, and the service may not be used as a primary backup repository. System-level disaster-recovery backups are not guaranteed to restore individual user data.
Data privacy and security
The Privacy Policy and, where applicable, DPA govern processing and describe rights under laws including GDPR and CCPA. WeaveNode will maintain reasonable technical and organizational safeguards; users remain responsible for secure configuration and their own protection and backup practices.
After termination, User Content is retained for a 30-day grace period so you can request a copy. Permanent deletion then begins and may take up to 180 days, including backup removal. AUP-violating content or accounts inactive for 90 days may be deleted immediately.
Disclaimer of warranties
The service is provided “as is” and “as available,” with all faults and without express, implied, statutory, or other warranties. WeaveNode does not promise uninterrupted, error-free, or secure operation, or that defects will be corrected. Use is at your own risk.
Limitation of liability
To the fullest extent permitted by law, WeaveNode and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profit, data, business interruption, or replacement services.
Total aggregate liability is capped at the greater of $100 or the amount you paid for the service during the 12 months before the event giving rise to the claim.
Indemnification
You agree to defend and hold WeaveNode, its affiliates, officers, directors, employees, and agents harmless from claims connected to your content, use of the service, violations of the agreement or incorporated policies, violations of law, or infringement of a third party’s rights. WeaveNode may assume the defense, with your cooperation and at your expense.
Dispute resolution
Disputes are assigned to binding arbitration before one arbitrator under the American Arbitration Association Commercial Arbitration Rules. Proceedings must be individual; class, consolidated, and representative actions are waived. Courts may still grant provisional remedies that support arbitration.
The live terms omit the governing state, arbitration venue, and court location. Those missing jurisdiction details have not been invented here.
Miscellaneous
WeaveNode may update the agreement by posting a new version; continued use after changes take effect is acceptance. If one provision is invalid, the rest remain in force. The terms, AUP, Privacy Policy, and DPA form the entire agreement. Notices may be posted on the website or sent to the email tied to your account.
